GUIDANCE NOTES ON PARENTAL RESPONSIBILITY

Parental Responsibility is a legal status.  However, most parents are unaware of this term and think that it means that they have the responsibility to look after them. 

If a parent has Parental Responsibility we are legally obliged to keep them informed of the child’s progress (the minimum being the report at the end of the year) and cannot refuse access to the child.

Below are notes from Cornwall Council which outlines who has Parental Responsibility and who does not!

Please note – a parent has Parental Responsibility for their children up until they reach the age of 18.

  • Mothers always automatically have Parental Responsibility unless this is limited by a Court Order.

Fathers have Parental Responsibility if:

  • they were married to the child’s mother at the time of the child’s birth;
  • they were not married to the mother at the time of the child’s birth but subsequently enter into a written parental responsibility agreement with mother;
  • they were not married to the mother at the time of the child’s birth but subsequently obtained a Court Order to acquire parental responsibility;
  • they were not married to the child’s mother at the time of the child’s birth but subsequently they obtained and were named in a Residence Order relating to the child;
  • they were not married to the mother at the time of the child’s birth but following the child’s birth the natural father married the child’s mother.
  • they were not married to the mother at the time of the child’s birth but are registered as the father on the birth certificate.   NB this only applies where the child was born on or after 1 December 2003.

Other persons may acquire parental responsibility, for example, the local authority if it obtains a Care Order for a child, the adopted parents of a child who is legally adopted and, a guardian, in cases where someone is officially appointed a guardian of a child.  Please contact the school office if you have any questions relating to Parental Responsibility.
